The ECHR resumed consideration of another claim of Georgia against the Russian Federation

The European Court of Human Rights (ECHR) has resumed consideration of Georgia's claim to hold Russia responsible for the occupation of the country's territory and the oppression of ethnic Georgians. This is stated in the message of the Ministry of Justice of Georgia, distributed on Thursday.

This is the fourth interstate claim of Georgia against the Russian Federation, which was sent by the Ministry of Justice to the ECHR on August 21, 2018.

According to the ministry, it refers to "mass harassment of the Georgian population", as well as" administrative practice of detentions, attacks and murders " in the territories not controlled by the central authorities of Georgia and along the administrative borders with them.

Tbilisi demands to establish Moscow's responsibility for violating several articles of the European Convention on Human Rights.

"In particular, Russia's continued occupation, stretching of barbed wire and targeted campaign against the population of Georgia violates such articles of the European Convention as the right to life, the prohibition of torture, the right to freedom and security, the right to personal and family protection, the right to an effective remedy, the right to education and freedom of movement," the ministry said in a statement.

The Ministry of Justice emphasizes that the lawsuit pays special attention to the cases of Archil Tatunashvili, Gigi Otkhozoria and David Basharuli, who were killed in the territories of Abkhazia and the Tskhinvali region. The Georgian side is deprived of the opportunity to conduct a full-fledged investigation, identify, and arrest the perpetrators. Tbilisi believes that Russia is harboring the security forces responsible for the deaths of three Georgian citizens.

Consideration of the fourth interstate claim of Georgia against the Russian Federation was suspended until the announcement of the decision in the case of the August 2008 war. The ECHR announced its decision on this claim on January 21, 2021.

Then the court found that after the fighting, Russia violated six articles of the European Convention for the Protection of Human Rights and Fundamental Freedoms: the right to life; the prohibition of torture and punishment, inhuman or degrading treatment; the right to freedom and security; the right to protection of private and family life; protection of property; freedom of movement.

At the same time, it was noted that these violations apply to the events that followed the ceasefire on August 12, 2008, and the events that took place between August 8 and 12, 2008, do not fall under the jurisdiction of the Russian Federation.

The Georgian side took this decision of the ECHR as its own victory. In Tbilisi, they emphasize that it was thus established that Russia exercises effective control over the Tskhinvali and Abkhazian regions of Georgia and is responsible for violations of the rights of Georgian citizens.
