An ISIS member has appeared in court in Germany for aiding the genocide of Yazidis

A criminal trial has begun in the Supreme Regional Court of the German city of Koblenz against a German ISIS member accused of complicity in genocide after her mistreatment of a young Yazidi woman in support of the ISIS campaign to destroy Yazidi community.

The 37-year-old German national, known as "Nadine K.," returned to Germany from Syria last year and was charged with aiding genocide, as well as war crimes and crimes against humanity, including enslavement, religious and gender-based persecution, and aiding rape and torture.

The surviving Yazidi woman, hereinafter referred to as N., participates in the trial as a co-witness and is a key witness in the case. Her interests are represented by British lawyer Amal Clooney and German lawyers Sonka Mehner and Natalie von Wistinghausen.

For about three years, until March 2019, in different places, the spouses of ISIS members kept N. as a slave in their house, where she was raped and subjected to forced labor. Yazidi woman, who was 21 years old at the time she was brought to their house, was "presented" to the husband of the accused ISIS, and later relocated to the Al-Hol camp and held there until she managed to escape.

The accused knew that her husband regularly raped N. and beat her, including when she tried to resist rape. The accused contributed to the rapes and physical violence, ensuring the capture of N., including during the absence of her husband. From dawn to dusk, Yazidi woman was forced to work – she had to clean, cook, take care of the accused's children and animals. The accused and her husband forced N. to pray 5 times a day in accordance with Islamic rules and observe fasting during Ramadan. The defendant knew about the ISIS genocide campaign against the religious minority of Yazidis, and she knew that her actions served the stated purpose of ISIS to destroy the faith of Yazidis.

The defendant, Nadine K., was captured by Kurdish forces in 2019 when she and her family tried to flee Syria to Turkey. She and her children were held in camps in northern Syria until their repatriation to Germany in March 2022. She was arrested upon arrival and charged in September 2022.

The full list of charges against Nadine K. includes:

• Membership in a foreign terrorist organization;

• Complicity in genocide by creating living conditions for the group designed for its physical destruction, causing serious mental harm to members of the group;

• Crimes against humanity, including enslavement, cruel imprisonment, religious and gender-based persecution;

• Complicity in crimes against humanity, including the creation of living conditions with the intention of complete or partial destruction of the population, designed for its physical destruction, forced displacement, torture, rape, causing serious mental harm;

• Aiding and abetting war crimes, including torture, rape, forced relocation;

• Human trafficking and exploitation;

• Violations of the Law on the Control of Military Weapons and the Law on Weapons.

Special notes:

According to German law, victims of serious crimes have the right to participate in criminal proceedings as "co-plaintiffs" along with the prosecution and defense. For her safety, the victim's identity has not been disclosed. Therefore, in this statement, she is referred to as "N".

German law, as a rule, also does not allow the full names of the accused to be disclosed. Thus, the defendant is identified as "Nadine K." throughout this statement.
