Council of Europe demands that the Russian Federation pay compensation to Georgia in the "case of the deportees"

The Committee of Ministers of the Council of Europe once again called on Russia to implement the decision of the European Court of Human Rights (ECHR) on the "deportee case" and pay "fair compensation" to Georgia.

This is stated in the interim resolution of the Committee of Ministers of the Council of Europe, the document is at the disposal of "NewsGeorgia".

The Committee expressed deep concern that the payment was not made more than three years after the deadline. It was confirmed that "the payment of fair compensation awarded by the court is an unconditional obligation" of the Russia.

"The delay in fulfilling this obligation deprives individual victims of violations of the right to receive compensation for the damage caused to them", the document says.

The Committee of Ministers of the Council of Europe again called on the Russian authorities to pay compensation together with accrued interest without further delay. 

At the same time, the authorities of the member States of the Council of Europe were invited to "explore all possible ways to ensure the execution of this case".

The secretariat of the Committee of Ministers has been instructed to submit proposals on a strategy for overseeing the execution of pending cases against the Russia.

We are talking about mass detentions and expulsions of many Georgian citizens from Russia between late September 2006 and late January 2007. In Tbilisi, this was regarded as a response by the Russian leadership to the arrest of four Russian officers in Tbilisi on charges of espionage.

The Georgian Government filed an interstate complaint with Strasbourg in March 2007.

According to the decision of the Grand Chamber of the ECHR of January 31, 2019, compensation in the amount of 10 to 15 thousand dollars should be paid to at least 1,500 citizens of Georgia, in respect of whom Russia violated several articles of the European Convention during mass deportation.

Against the background of the ongoing war against Ukraine, Russia announced its withdrawal from the Council of Europe on March 15. In June, the State Duma of the Russian Federation adopted a package of laws on non-enforcement of ECHR decisions.
