The next court hearing on the case of human rights defender Sashik Sultanyan was held on January 26 in the Court of General Jurisdiction of Yerevan.
Recall that he was charged under Article 226, part 2, paragraph 1 of the RA Criminal Code (incitement of national, racial or religious enmity), according to which the statement about the violation of the rights of Yezidis living in Armenia was qualified as inciting national enmity.
Sashik Sultanyan's rights are defended by Samson Galstyan, lawyer of the Vanadzor Office of the Helsinki Civil Assembly, and Ara Ghazaryan, lawyer.
The illegal criminal prosecution of Sashik Sultanyan was condemned by both Armenian human rights organizations and other representatives of civil society, as well as authoritative international human rights organizations. The RA Human Rights Defender also expressed concern.
The Commissioner of the Council of Europe for Human Rights Dunya Mijatovi appealed to the Prosecutor General of the Republic of Armenia for clarification on the case of Sashik Sultanyan.
At the previous court hearing, the defenders first acted as intermediaries in the cancellation of the preventive measure "not leaving the country", in relation to Sashik Sultanyan. Despite the arguments of the defenders, the court rejected the petition.
Then the defenders petitioned for the suspension of the criminal case by appealing to the Constitutional Court regarding the constitutionality of article 226 of the Criminal Code. The Court considered it expedient to postpone consideration of the petition after examining the evidence.
Prosecutor A. Karapetyan presented the final part of the charge. Sashik Sultanyan mentioned that he does not understand what he is accused of․ The testimony attributed to him in the indictment does not correspond to reality. The translation was made improperly. He added that the statements he made were not public, it was a conversation, immediately after publication he demanded to remove the material from the site, which was done.
Sashik Sultanyan said he would plead not guilty to the charges.
